By creating an account, purchasing a plan, or using the Service in any way, you agree to these Terms. If you do not agree with them, you must not access or use the Service.
To use the Service, you must be at least 18 years old, or the legal age of majority in your jurisdiction, and able to enter into a legally binding agreement. By creating an account, you confirm that you meet these requirements and that the information you provide — including your name, email address, and billing details — is accurate, current, and complete.
You are responsible for keeping your account credentials, including your password and any API keys issued to you, secure and confidential. If you become aware of unauthorized access or use of your account, you must notify us promptly at service@graviix.com. Graviix is not responsible for loss or damage resulting from your failure to properly protect your account credentials.
You may not create an account for another person or entity without proper authorization, and you may not maintain multiple active accounts unless your selected plan or a separate agreement with Graviix allows it.
Graviix provides proxy network infrastructure, including residential, datacenter, and mobile proxy access, along with a client dashboard for managing subscriptions, monitoring usage, generating credentials, and handling billing. The Service is designed to support legitimate activities such as market research, price monitoring, brand protection, and public data collection.
We may improve or update the Service over time, so available IP pools, geographic coverage, bandwidth allowances, connection performance, and dashboard features may change. We may add, modify, suspend, or discontinue features or plans at our discretion. Where reasonably possible, we will provide advance notice of material changes that significantly affect the functionality of a paid Service.
Nothing in these Terms guarantees a specific level of uptime, IP availability, connection speed, or overall performance unless a separate written service-level agreement between you and Graviix expressly provides otherwise.
You agree to use the Service only for lawful purposes and in a way that does not violate the rights of others or interfere with the Service or third-party systems. Without limiting the above, you must not use the Service, or allow others to use it, to:
You are responsible for ensuring that your particular use of the Service — including web scraping, automation, and data collection — complies with the terms and policies of the websites you access and with applicable data protection, privacy, and computer-use laws in your jurisdiction.
Key point: A violation of this Acceptable Use Policy may result in suspension or termination of your account, subject to these Terms and any applicable refund provisions. Where required by law or valid legal process, we may disclose relevant account or usage information to appropriate parties, service providers, or law enforcement authorities.
Paid plans are billed according to the billing terms shown on our pricing page or at checkout. Depending on the selected plan, charges may apply monthly, annually, or based on included usage. By providing a payment method, you authorize us or our payment processor to collect the applicable fees and taxes associated with your selected plan.
Subscriptions renew automatically where applicable unless you cancel before the next renewal date. You can manage cancellation options through your dashboard. Unless otherwise stated, cancellation takes effect at the end of the current billing period, and you may continue using the Service until that period ends.
Unless otherwise stated in our pricing or agreed in writing, fees are non-refundable once proxy access or allocated resources have been provided to your account. This may include partial-period cancellations or unused bandwidth. Failed or disputed payments may result in temporary account restrictions until the outstanding balance is resolved.
We may update our pricing, plans, or service structure from time to time. Where changes affect an existing subscription, we will provide reasonable notice where applicable, and updated pricing will generally apply from the next renewal period.
The Service — including its software, network architecture, dashboard, documentation, trademarks, logos, and related brand assets — is owned by Graviix or its licensors and is protected by applicable intellectual property laws.
These Terms provide you with a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes, provided that you comply with these Terms. You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works from the Service, except where permitted or required by applicable law.
The Service may be used with third-party browsers, automation frameworks, browser tools, and other workflow platforms. Graviix does not control and is not responsible for the availability, content, security practices, or terms of third-party websites, tools, or services that you access through our proxy network.
Any data you collect, store, or process using the Service — including information obtained from third-party websites — remains your responsibility. You must ensure that your collection and use of such data comply with applicable privacy, data-protection, and other relevant laws, including obtaining any required permissions or consents.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will always be uninterrupted, timely, secure, or error-free, or that any specific IP address, location, or bandwidth allocation will remain continuously available.
You acknowledge that proxy and internet infrastructure may be affected by circumstances outside our control, including upstream provider outages, target-website restrictions, network conditions, and changes to third-party policies or infrastructure.
To the maximum extent permitted by applicable law, Graviix — including its officers, employees, and affiliates — will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of, or inability to use, the Service, even if we have been informed that such damages may occur.
Our total liability for all claims arising from or relating to these Terms or the Service will not exceed the total amount you actually paid to Graviix during the three (3) months immediately before the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations of liability, so some of these limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Graviix, its officers, directors, employees, and business partners from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to: (a) your access to or use of the Service; (b) your breach of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any data collected or activity carried out through your account.
You may cancel your account and stop using the Service at any time through your dashboard settings. After cancellation, your access will generally remain available until the end of your current billing period, after which your account and related data may be deactivated in accordance with our data-retention practices.
We may suspend or terminate your access to the Service, with or without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, failed to pay applicable fees, or created a security or operational risk for the Service or other users. Provisions that are intended to survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain effective after your account is closed.
These Terms are governed by and interpreted in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute, controversy, or claim arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state or federal courts located in New Castle County, Delaware, USA, and you consent to the jurisdiction of those courts, unless applicable consumer-protection law provides otherwise.
We may update these Terms from time to time to reflect changes to our Service, legal requirements, or business practices. When changes are made, we will update the "Last updated" date at the top of this page and may notify you of material changes by email or through your dashboard. Continued use of the Service after revised Terms become effective means you accept the updated Terms. If you do not agree with the changes, you must stop using the Service.
